Hi Heinrich -
Your questions pertain to BLM-administered lands within Section 15, T. 2 S., R. 4 E. I am attaching a survey
plat of this parcel for your reference, as I refer to the lot numbers shown on the plat.
Color of Title Application: The three houses we discussed are located in lot 29, containing .31 acres. An
application was filed on this parcel in 2007 by Richard Dennis, claiming title to .74 acres under the Act of
December 22, 1928, commonly known as the Color of Title (COT) Act. The last time I checked with Dave
Watson, BLM Salt Lake Field Office, on the status of this application (likely in response to Patty's call several
months ago), he indicated that it should be processed this year.
Competitive Sale of Lands: Section 2609 of Public Law 111-11 directs the competitive sale of two BLM
parcels (17 and 18). Parcel 18 was described as lot 23, Sec. 15 in the 1975 Park City Management Framework
Plan. This lot was subsequently resurveyed and subdivided into three separate lots (26, 28 and 29) to
accommodate the two COT applications. Lot 28, encompassing the 2.57 acres not encumbered by the COT
claims, must be sold competitively at fair market value pursuant to PL 111-11. I don't believe conveyance of
this acreage under the R&PP Act would be an option for the BLM. I may have misinformed Patty earlier on
this, not knowing what specific land she had in mind.
I recall that the Bertagnole parcel was encumbered by an active mining claim that required relinquishment prior
to conveyance of the land from Federal ownership. I would assume the claim extends to both the Dennis COT

and competitive sale, and am not sure how this is being addressed by the Field Office in processing these
actions. You may already be aware of this.
I recommend that you follow up with either Kevin Oliver, West Desert District Manager (801-977-4310), or
Bekee Hotze, Salt Lake Field Office Manager (801-977-4300) to confirm their timelines for completing these
actions. Feel free to call if I can be of further assistance.

I just want to confirm, on behalf of a constituent, the following:
-Homes located on this property are currently in the ‘quite title’ process, subject to the Dennis family.
Completion sometime 2015
-Per congressional decree, the remaining acreage is to be disposed through public auction after Dennis QT is
completed.
-Acquiring the remaining acreage through the RP&P process is not an option.
This is the same information Dave Watson has provided previously, sans the RP&P question and I have no
reason to believe it has changed; however, the aforementioned constituent asked me to specifically reach out to
you.
Please let me know if I have referred to everything correctly.
Park City does have strong open space, recreation and historic preservation goals, which these properties
represent, so we are very interested in the process and would love to have any and all opportunity to attain those
goals.
