Since they withdrew their application, no appeal can be made. If the Bertagnoles or a new owner was able to come up
with new information, we may be able to reconsider the historic designation of the house; however, I think this would
be very unlikely as we have a pretty thorough documented history of the building. The Bertagnoles have lost their right
to appeal because they withdrew the application.

I am putting this in a closed report…can you confirm the Bert’s ability to appeal to BOA? Is there a timeline for appeal
per legal’s input??
I want to confirm if they still have ability to appeal and if so in what time, to whom???
In May 2014, the Bertagnoles filed for a ‘Determination of Historical Significance’ with the City. The HPB found the
structure to be “Significant” once again. The Bertagnoles chose again to appeal this decision to the Board of Adjustment
(BOA); however, on July 9, 2014, staff received email notification from property owner Juli Bertagnole that the owners
no longer intended to pursue their appeal to the Board of Adjustment. Thus, a final determination of the ‘appeal’ has
yet to be provided and the Bertagnole’s still retain the ability to appeal to the BOA. What is deadline for filing appeal
of determ of HS? It sounds like the appeal – presumably timely filed – has been withdrawn and the deadline for
appealing the determ has passed.
