Response - BuildingDecember 7, 2021 Katherine Kendall 2543 Lupine Lane Park City UT 84060 Re: GRAMA request Dear Katherine: Park City Municipal has received your GRAMA request dated December 1st for the variance from Park City to allow encroachment of front setback with an excavation and wall at 2567 Columbine Court. The homeowners have told our HOA president that they have received permission from the city to encroach on the 10 foot front setback with a steep excavation and wall. The HOA would like documentation of the variance and/or permission granted in order to explain the exception to the other homeowners. Based on your request, we are unable to process this request- the variance has not been completed for this property. Please feel free to contact Rebecca Ward or Heather Wasden in the Planning Dept. 435-615-5060 for updates regarding the variance. Cost Due: $0.00 Pursuant to Municipal Code § 5-2-1, you may appeal this decision to the City Manager by filing a notice of appeal within 30 days of the date of this letter. The appeal must include the following: (1) Your name, mailing address, and daytime phone number; (2) relief sought; and may include (3) a short statement of facts, reasons, and legal authority in support of the appeal. The City Manager will make determination within 10 business days of receipt of the appeal, or within five business days of receipt of the appeal if the requester or interested party demonstrates that an expedited decision benefits the public rather than the requester or interested party, or within twelve business days after the City sends the requester’s notice of appeal to a person who submitted a claim of business confidentiality. If the City Manager fails to make a determination within this period, this shall be considered the equivalent of an order denying the appeal.
