A RESOLUTION ANN EXING .92 ACRES
KNOW AS THE ROSS PROPERTY
INTO THE CORPORATE LIMITS OF PARK CITY, UTAH
WHEREAS , a petition was filed by Vicki Ros s, the owner of
the land included within the area described on the attached
Anne xation Plat , request ing Park City to annex that land to the
City, zoned as single family (SF); and
WHEREAS , the land is included within the City's
Annexation Pol icy Declaration Statement and Anne xation Boundary
area; and
WHEREAS , public hearings , as required by law, were held
before the Planning Commi ssion on May 26, 1993 , and the City
Counc il on July 8, 1993 ; and
WHEREAS , the att ached Annexation Agreement (Exhibit A)
was approved by the Planning Commission at its me eting of May 26,
1993 , approved by the City Counc il at its meeting of July 8, 1993 ;
and
WHEREAS , the land in que stion is not included within any
other municipal jurisdiction, and there have been no protests to
the ann exation filed by any other jurisdiction ;
NOW , THEREFORE , BE IT RESOLVED by the City Counc il of
Park City, Utah that the land described on Exhibit A to the
Ann exat ion Agreement is hereby annexed to the corporate limits of
Park City, Utah .
SECTION 1. ANNEXAT ION . The land so annexed shall be
entitled to receive all City services on the same bas is as other
land within the City, and shall be subj ect to all City levies and
assessments as described in the terms of the
Exhibit A.

ANNEXAT ION AGREEMENT
AND SUPPLEMENTAL ANNEXATION POLICY DECLARATION
ROSS PROPERTY
This Annexation Agreement is made by and between Park
City Municipal Corpora tion and Vicki Ross (hereinafter "Ro ss ") to
set forth the terms and conditions under which Park City agrees to
annex a portion of the property owned by Vicki Ross and ext end its
municipal services to that property . This agreement , a
supplemental pol icy declaration, is made under autho rity of Utah
Code Annotated section 10-2 -414 , ( 1953 , as amend ed ) . In
consideration of Park City • s agreement to annex Ross ' s property and
in consideration of the mutual promises contained herein , the
parties agree that the terms and conditions of annexation shall be
as fol lows:
1. Property. The property to be annexed is described on
the annexa tion plat attached as EXHIBIT A, filed by Ro ss . The
property is in Summit County and is commonly known as the Ro ss
Property .

3. Uses of the Property . The property shall be allowed
to accommod ate a single family residen.c e which currently includes
secondary living quarters , and no add itional subdivisions shall be
considered . The property owner shall be allowed to continue to
have four horses for personal us e, which is a non-conforming use,
for a period not to exceed ten years or sooner through natural
attrition . If the property owner discontinues that use for a
period of one year or transfers ownership of the property, the
owner shall be required to comply with the Land Management Code
requirements, including the number of animals allowed , in place at
the time .
4. Annexa tion Fees . Ro ss agrees to pay Park City's
costs associated with the processing of the annexation petition,

including publication fees and any spec ial or extraordinary costs
associated with the annexation .
5. City Fees . Upon annexation, the property is for all
purposes part of Park City, and is fully subj ect to all of its
policies , ordinances , regulations , and tax levies , including levies
for previously issued bonds . Ross agrees to pay water development
and connection fees .
6. City Services . City services provided to other
properties in Park City wi ll be provided to the annexa tion property
on the same bas is as they are provided to other similarly situated
properties .
7. Parks and Dedication Fees . Ro ss agrees to pay a parks
dedicat ion fee of $1,035 .00.

Dear Ms . Ross:
I have taken the opp ortunity to review the water right represented
by Exchange App lication 1026 and Davis and Weber Canal stock
certificate 13150 . It is my understanding that you would like to
trans fer this water right to Park City in lieu of a water
devel opment fee . It wi ll be my recommendat ion to the City Council
that the City accept thi s water right in lieu of a water
development fee subj ect to approval by the State Engi neer .
However , you should be aware that once this water right is
transferred to the City you wi ll have no legal right to use your
we ll . You will have access to City wat er upon connection to the
City system and will be required to pay cul inary rates for all
water usage .
Al so, you should be aware that the water devel opment fee is
separate from the water connection fee . The water development fee
represents the cost of acquiring water rights whi le the conne ction
fee is for the actual connection to the City's sy stem. Finally,
there may be some mo difications or ad dit ional plumb ing that wi ll be
required before you can connect to the City system . If you have
any questions regarding plumb ing or connection issues , I would
suggest that you contact the water department .
If you have any other qu estions , please do not hesitate to contact
me . Upon the approval of the annexation we can make arrangements
for the transfer of the water rights to the City .
