THE ESTATE OF JENNIE C. PETERSON
AND ASSOCIATED RIGHTS OF WAY
INTO THE CORPORATE LIMITS OF PARK CITY,

WHEREAS , a petition was filed by the owners of land , the
Estate of Jennie C. Peterson , included within the area described on
the attached Annexation Plat , requesting Park city to annex that
land to the city , zoned as Estate (E), and Recreation Open Space
(ROS); and
WHEREAS , the land is included within the city 's
Annexat ion Pol icy Declaration Stat ement and Annexation Boundary
area ; and
WHEREAS , the City has been working with the property
owners for over a year on the purchase of a portion of this
property for the enhancement of the city 's entry corridor ; and
WHEREAS , the property contains signif icant aesthetic
value which will be improved as part of the future improvements to
portions of the land; and
WHEREAS , the Army Corps of Engineers has identified
portions of this property as wetlands with signif icant
environmental value which will be improved in conjunction with the
annexation and development of portions of this property ; and
\'l HERE ... 1\.S , the appl ications for annexation and master
planned devel opment for this property were received in advance of
the adoption of the Sensit ive Lands Ordinanc e, yet have been
des igned and planned to meet the spirit and intent of the
Ordinance; and
WHEREAS , public hearings , as required by law , were held
before the Planning Commission on December 2, 1992 and the city
Council on December 17, 1992 ; and
WHEREAS , the attached Annexation Agreement (Exhibit A)
was approved by the Planning Commission at its meet ing of December
2, 1992 and approved by the city Counc il a t its meeting of December
17 , 1992 ; and

WHEREAS , the land in question is not included within any
other municipal jurisdiction , and there have been no protests to
the annexation filed by any other jurisdiction ;
NOW , THEREFORE , BE IT RESOLVED by the City Council of
Park City , Utah that the land described on the annexation plat , the
North Ha lf of the Southeast Corner of Section s, Township 2 south ,
Range 4 East , Salt Lake Base and Mer idian , is hereby annexed to the
corporate limits of Park City , Utah .
SECTION 1. ANNEXATION . The land so annexed shall be
entitled to receive all City services on the same ba sis as other
land within the city , and shall be subject to all city levies and
assessments as described in the terms of the Annexation Agreement ,
Exhibit A·
SECTION 2. EFFECTIVE DATE . This Resolution shall take
effect upon passage , provided that the annexat ion shall not be
deemed completed until this Resolution is recorded in the Office of
the Summit County Recorder together with the Annexation Plat .

AND SUPPLEMENTAL ANNEXAT ION POLICY DECLARAT ION
FOR THE PETERSON PROPERTY
This Annexation Agreement is made by and between Park
City Mun icipal Corporation and. Mr. Phillip Michael Wr ight
representing the Estate of Jennie c. Peterson, to set forth the
terms and conditions under which Park City agrees to annex real
property owned by the Estate of Jennie c. Peterson and extend its
municipal services to that property . This agreement , a
supplemental annexation policy declaration , is made under authority
of Utah Code Annotated section 10-2-414 , (1953 , as amended ). In
consideration of Park City's agreement to annex the Peterson
Estate 's real property and in consideration of the mutual promises
contained herein , the parties agree that the terms and conditions
of annexation shall be as follows :
1. Property . The property to be annexed is described as
North half of the southeast quarter of Section 5, Township 2 South,
Range 4 East , Salt Lake Base & Mer idian . The property is in Summ it
County and is common ly known as The Peterson Property .
2. Zon ing . Upon annexation the property will become
subj ect to the Park City Land ·Management Code , Subdivis ion
Regulations ; and other City regulations . The property will be zoned
in two areas as shown on the annexation plat for the property . The
zones sha ll be Recreation Open Space (ROS), and Estate (E). An MPD
is being approved concurrent ly by the Planning Commission
establishing a density of 7 single family dwellings . This density
and master plan have been determined in light of the sensitive
wetlands , open space , and entry corridor , and in consideration of
the requirements of the Park city Sensit ive Lands Ordinance which
has been app lied to this property .
3. uses and Maintenance of the Property . It is the
intent of the parties hereto that the appearance of the area zoned

ROS be maintained in its undeveloped state except as provided by
the Land Management Code . A Meadow Maintenance Agreement and Animal
Management Plan, and a Wetlands Mitigation Plan shall be entered
into at the time of Prel iminary Plat approval of the Master Planned
Developm ent , which will ensure proper maintenance of the meadow and
wetlands areas . The intent of the Maintenance Agreement will be to
preserve and enhance the environmental and visual features of the
property , and limit all impacts to these areas .
4. Annexation Fees . The Estate of Jennie c. Peterson
agrees to pay Park City 's costs associated with the processing of
the annexation petition, including publication fees and any special
or extraordinary costs associated with the annexat ion .
5. City Fees . Upon annexation, the property is for all
purposes part of Park City, and is fully subject to all of its
policies , ordinances , regulations , and tax levies , including levies
for previously issued bonds . All subdivision and building related
fees , including water connect ion , water development , parks
development , building permit , engineering inspection and general
impact fees will be imposed on the annexed property in the same
manner that they are applied elsewhere within Park City .
6. City Services . City services provided to other
propert ies in Park City will be provided to the annexation property
on the same basis as they are provided to other similarly situated
propert_ies . Snow removal will be provided by the petitioner , their
subsequent purchasers of lots, or owners association at their cost
until more than 50% of the lots are improved and houses ?ccupied ,
at which time the city wi ll undertake snow removal services .
7. Employee Housing Requ irement . The City 's requirement
to provide moderately priced employee housing shall be met either
by the construction of restricted emp loyee housing units or by
payment to the Park City Housing Authority in lieu of construction
of a percentage of the total density, based upon the requirement of
one emp loyee dwe lling unit per 10 single family lots as stated in
the Annexation Policy Declarat ion .

a. Road Des ign . Park City agrees to consider road
designs submitted by registered engineers on the Estate 's behalf ,
and agrees that roads within the project will be required to meet
Park city standards for residential street s, including adequate
provision for construction traffic .
9. Dedication of Water Rights . The Estate has met its
water rights dedication obligation by agreement between the Estate
and Park City dated December 17, 19 92.
